What is Earbank?

Earbank.com sells royalty-free news and sports broadcast audio clips for use in your editorial projects.

 

How does it work?

Here is how Earbank works:

  1. Search for the clip you want, or browse one of our collections.
  2. Review the clips you find. You can listen to a ‘watermarked’ preview of the full clip. The watermark does not appear in the final version of the clip.
  3. If you find a clip you like, add it to your shopping cart.
  4. Check-out with your credit card number to complete the transaction.
  5. You will immediately be sent a confirmation email, which contains your license to use the clip, and a link to download a high quality WAV file.
  6. Go ahead and use the royalty-free clip in your editorial projects.

 

What’s the catch?

There is no catch; although there are a few important things you should keep in mind:

  • The clips are licensed for editorial use only. They cannot be used in commercial advertising projects.
  • We sell Premium, Basic, and Segment licenses. There are different rules for each type of license, which are explained here.
  • The clips are royalty-free for the original purchaser or company named in the receipt. You cannot give or sell the clips to anyone else, outside of your own company. They’ll have to buy their own clips.

How may I use the clips, and how do the different types of licenses work?

You may use the clips royalty-free, in perpetuity, for editorial use only. However, additional restrictions may apply, depending on the type of license you have purchased to use the clip.

What is royalty-free?

It means that you’ve been granted a license to use the clips in perpetuity, without paying additional fees or royalties to earbank.com or the original broadcaster.

 

Do your clips have model releases, property releases, or performance rights?

No. None of our clips have:

  • Model releases, where a person speaking in the clip has signed a model release permitting their voice to be used for commercial purposes;
  • Property releases, where the owner of any trademarks discussed in the clip have signed a release permitting the clip to be used for commercial purposes; or
  • Performance rights, where the performer in the clip has given permission to have their work used for commercial purposes.
As a result, these clips can only be used for editorial purposes.

 

What is editorial use?

"Editorial use" includes using the clip is used for the purposes of news reporting, research, education, commentary, criticism, parody, or satire.

For example, using a clip in a news or commentary segment of an ad-supported podcast is considered “editorial use”. Using the same clip in one of the podcast’s ad segments, or a branded content podcast is considered “commercial use”.

 

What is commercial use?

Commercial use is when the clip is used to promote a product, service, or company. If you’re using the clip to advertise a product or service, then it’s commercial use.

For example, using a clip in a news or commentary segment of an ad-supported podcast is considered “editorial use”. Using the same clip in one of the podcast’s ad segments, or a branded content podcast is considered “commercial use”.

 

How am I not permitted to use the clips?

No standalone use. You may not sell, share, or distribute the Clip on its own. The Clip must be incorporated into a larger work produced by yourself.

No commercial use. You may not use the Clip for commercial or advertising purposes, i.e., to promote or advertise a product or service.

No misrepresentation. You may not modify the Clip in a manner that changes the context of the Clip or misrepresents the persons interviewed in the Clip.

No illegal use. You may not use the Clip for any purpose which is defamatory, libelous, obscene, illegal, pornographic, or in a manner that violates the rights of any third party.

No discriminatory use. You may not use the Clip for any purpose which supports, promotes, or advocates for the discrimination of any person based on race, national or ethnic origin, colour, religion, sex, sexual orientation, age, or mental or physical disability.

No sampling. You may not incorporate the Clip in a musical work.

May I share the clips with other people?

Only if these other people work at the same company which you identified in the billing address at checkout,

If no company was named at checkout, then the license to use the clips is only granted to yourself, as an individual.

In no circumstances may you sell, share, or distribute the clips to anyone who has not purchased a license to use the clip.

 

I’m a freelancer and want to use a clip across multiple projects/clients. Is that permitted?

Yes, as long as the clip is incorporated into the client’s work, and you do not give the original standalone clip to the client.

 

Who owns the copyright for the clips?

The copyright for the clips is retained by the original broadcaster. When purchasing a clip at earbank.com, you are granted a royalty-free license to use that clip for editorial purposes.

SEARCHING FAQs

How do I search for clips from a specific date?

All clips are tagged by date in the year-month-date (YYYY-MM-DD) format. Searching for:

“date: 2000” will show you all clips from the year 2000
“date: 2000-05”will show you all clips from May 2000
“date: 2000-05-30”will show you all clips from May 30, 2000

 

How do I search for clips from a specific place?

Searching for:

“placeline: Montreal” will give you all clips with a placeline of Montreal.

Please note for news clips, the placeline often refers to the city in which the reporter filed the story, and not necessarily the city in which the news event took place.

 

How do I search for clips from a particular broadcaster?

Enter your keyword in the search field (or leave the field blank) and press the ‘search’ button. Then choose the broadcaster’s name from ‘Source’  filter in search results.

 

How do I search for clips by keyword tags?

Enter your keyword in the search field (or leave the field blank) and press the ‘search’ button. Then select one or more ’Tags’ from the filter in search results.

You can also filter clips based on tags. Go to “Browse All Clips” or choose a collection in “Browse by Collection”, and then filter the results by one of the tags in the “Show clips with tag” drop-down menu.

SALES AND PAYMENTS FAQs

Which payment methods do you accept?

We accept Visa, Mastercard, and American Express credit cards.

 

Which currencies do you accept?

All prices and payments are in U.S. dollars.

 

What is your refund policy?

All sales are final. We do not issue refunds.

If the audio clip you purchased and downloaded from us is damaged or corrupt, or does not match the preview file (minus the watermark), please contact us at service@earbank.com and we will send you a working file. If we cannot supply you with a working file, we will refund your payment.

  

Can you invoice us, or accept a purchase order?

Not for individual clips; although you may pre-purchase account credits which can then be used to buy individual clips. Please contact us at service@earbank.com for more details.

TECHNICAL FAQs

What is the quality of your audio clips?

The quality of the audio files varies, depending on age of the clip, background noise, and type of recording equipment used. The watermarked audio previews should give you a good idea of the quality of each original clip available for purchase.

 

What are the technical specifications for your clips?

All purchased audio clips are delivered with the following specifications:

  • File format: WAV
  • Channels: mono
  • Sample rate: 44.1 kHz
  • Bit rate: 128 kpbs
     

Do the purchased clips have an audio watermark?

No, when you purchase a file, we’ll send you an original quality clip, without a watermark.
