A Saskatchewan farmer lost a bid to have charges dropped for his border runs protesting the wheat board's monopoly. Dave Bryan's lawyer had argued that the board monopoly over wheat and barley violated farmers' property rights. But Manitoba Court of Queen's Bench Justice James Smith ruled the Canadian Wheat Board Act falls within the powers of the federal government to regulate trade and commerce. Bryan said he would appeal. Bryan was convicted of violating the Customs Act by hauling grain across the Canada-US border in 1996-97. He was fined nine thousand dollars and given a two-year suspended sentence.
