An Ontario Superior Court judge ruled September 9th that Canadian Blood Services was legally allowed to ban men who have sex with men from donating blood. She noted that Canadian Blood Services was not a government entity, so the charter did not apply to its policies. Doctor Graham Sher, head of Canadian Blood Services, said the policy is based on sound scientific evidence and is designed to protect people who are given donated blood. (The court sided with the blood agency against a man who said he donated blood many times, despite having had sex with men.)
